1. Acceptance of Terms

By accessing or using SOAK AI ("the Platform") at soak-ai.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

SOAK AI is a B2B sales automation platform that provides AI-powered lead generation, outreach automation, CRM, voice calling, SMS, email campaigns, and business analytics tools for businesses.

3. User Responsibilities

You are solely responsible for all content sent through the Platform including SMS messages, emails, and voice calls made on your behalf. You agree to comply with all applicable laws including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable state and federal regulations governing outreach communications.

4. Prohibited Uses

You may not use SOAK AI to send spam, harass individuals, contact people on Do Not Call registries without proper consent, violate any applicable law or regulation, impersonate any person or entity, or engage in any fraudulent activity. Violation of this section may result in immediate account termination.

5. Limitation of Liability

SOAK AI provides the Platform "as is" without warranties of any kind. SOAK AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid us in the three months prior to the claim.

6. Outreach Compliance

You acknowledge that you are the sender of all outreach communications made through the Platform. SOAK AI acts solely as a technology provider. You are responsible for ensuring all outreach complies with applicable telemarketing, email marketing, and privacy laws in your jurisdiction. You represent that you have the legal right to contact the leads you import into the Platform.

7. Payment and Billing

Subscription fees are billed monthly. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Failure to pay may result in service suspension.

8. Termination

We reserve the right to terminate or suspend your account at any time for violation of these Terms. You may cancel your subscription at any time. Upon termination your data will be deleted within 30 days.

9. Intellectual Property

All rights, title, and interest in the Platform including all software, algorithms, and content belong exclusively to SOAK AI. You may not copy, modify, reverse engineer, or create derivative works of the Platform.

10. Governing Law

These Terms are governed by the laws of the State of Kansas. Any disputes shall be resolved in the courts of Kansas.
